
About The Scheme
The Government has set up a portable long service leave scheme for employees in the construction industry. The scheme is run by a Board set up by the Government with representatives from both unions and employers. The Board is called the Construction Industry Long Service Leave Payments Board
What benefits does the Scheme offer?
The Scheme allows employees who are registered under the Scheme to carry their long service leave credits from job to job. After 10 years of service, calculated on the number of days worked in the construction industry, regardless of the number of employers worked for, employees get 8 2/3rd weeks paid long service leave.
How does the scheme work?
Every three months, employers in the construction industry advise the Board of how many days each employee has worked for them in the construction industry and pay a contribution to the Board based on a percentage of the ordinary rate of pay due for paid leave applicable to those employees.
The Board keeps a record of the days worked in the construction industry for each employee registered with the Board. Each employee can be credited with a maximum of 220 days of service per year towards their long service leave entitlement.
When an employee accumulates 2200 days of service in the construction industry (10 years of service) that employee is entitled to 8 2/3rd weeks long service leave. The Board pays the employee for the leave at the ordinary rate of pay due to the employee for paid leave averaged over the last 12 months of service (220 service days) recorded in the Scheme.
Pro rata (proportionate) leave of 6 weeks is applicable after 7 years service (1540 service days) to the industry. Also if an employee with a minimum of 7 years service (1540 service days) terminates their employment, or is terminated, they may claim a lump sum payment of any entitlement due.
Who pays for the Scheme?
Your employer.. It costs you nothing.
Does it cost anything to register?
No.
Who can register?
All those employed in the construction industry in a classification of work referred to in the Awards and temporary employees engaged under certain Government awards.
What types of work are included in the construction industry?
Such work includes all construction, alteration, renovation, repair or maintenance to any building or structure whether Commercial, Industrial or Domestic, new or existing and also includes the installation, maintenance of or repairs to fixtures or plant and equipment to name a few
How do I apply?
Click here to download a registration form or contact the Board for a registration form to be sent or you. Complete it and return it to the Board.
What happens then?
The Board will advise you whether they have accepted your application to register under the Scheme. If accepted you will be sent a registration card. Also each year you will receive an Annual Notice which will advise of the total service days accrued towards your long service leave entitlement. If you do not receive your registration card within a few weeks, please contact the Board.
Interstate service
About interstate service and portability
Following an agreement between similar long service leave Schemes operating in South Australia, Victoria, New South Wales, the Australian Capital Territory, Queensland, Tasmania and the Northern Territory, workers can now have their interstate service recognised when qualifying for long service leave in Western Australia.
What does this mean to me?
Under the Agreement you can work in the construction industry in more than one State and have your service from each of those State Schemes combined and credited towards your long service leave in the State you are currently working. For example, if you had worked interstate and accumulated 6 years service in Victoria and 4 years in Western Australia you would now be eligible to claim a long service leave entitlement in Western Australia having accumulated a total of 10 years of service.
When you make a claim you will be paid at the ordinary rate of pay due for paid leave averaged over the last 12 months (220 service days) recorded in the W.A. Scheme for the Western Australia portion of your service and at the rate of pay determined by the Interstate Boards concerned for the interstate portion of your service.
When can I apply for my long service leave?
The minimum number of service days required to claim long service leave varies from State to State. If you are moving interstate you should check with the Board in the State you are moving to for the entitlement provisions applicable in that State.
In Western Australia you need at least 7 years of service to make a claim.
In which State do I apply?
You must apply for long service leave in the Scheme in the State in which you last received service days.
Do I need to advise the WA Board of my interstate service?
Not until you are ready to apply for long service leave. In the meantime, you should keep a record of the service accrued in each State you have worked.
The Annual Notice sent to you each year by the Western Australian Board will only contain the service accumulated in Western Australia.
I am working interstate. How do I get my Annual Notices?
You can ensure you continue to receive your Annual Notice by advising the Western Australian Board of your change of address. If you are registered in other States you must also advise them of your change of address.
It is your responsibility to ensure your address is current with each Board.
What if I have a query with my service days?
The Western Australian Board can only recognise (upon confirmation) the service days detailed in the current Annual Notice/ Workers Certificate sent to you by the long service leave Boards in the States in which you are registered.
Any disputed queries relating to the allocation of service days or non-receipt of Annual Notices must be directed to the individual Board(s) concerned.
What if I am about to be de-registered in another State?
If you are now working in the construction industry in Western Australia and you are about to be de-registered by a long service leave Board in another State you should advise that State of your registration in Western Australia.
They will then restore your registration once they have confirmed you are registered with the Western Australian Board.
